Terms of Service

1. Agreement to these Terms

BidInsta is operated by @techie0072 (referred to as “BidInsta,” “we,” “us,” or “our”). By accessing the service, checking the legal acceptance box, placing a bid, or completing a purchase, you confirm that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

You must be at least 18 years old and legally capable of entering a binding contract. If you act for a business or another person, you confirm that you have authority to bind them.

2. How BidInsta works

BidInsta is a paid public discovery board for Instagram handles. A completed total bid determines a handle’s position. Higher bids rank above lower bids; ties may be resolved by the time the qualifying payment was completed. If another person bids more, your listing may move down but can remain visible at the position its paid total can hold.

Rankings, click counts, follower context, and other statistics may be delayed, corrected, or unavailable. BidInsta does not guarantee impressions, clicks, followers, engagement, sales, revenue, account growth, or any other result.

3. Your Instagram handle and authority

You may submit only a handle that you own, control, or are expressly authorized to promote. You are responsible for the accuracy of the handle and for having all rights, permissions, trademark rights, and other authority necessary to list it.

You grant BidInsta a worldwide, non-exclusive, royalty-free license to display and link to the submitted handle and to display public profile information reasonably necessary to operate and promote the board. You do not give BidInsta ownership of the Instagram account.

5. Payments, taxes and refunds

Payments are processed by Dodo Payments as merchant of record. Checkout, payment methods, taxes, billing information, chargebacks, and payment processing are also governed by the Dodo Payments Buyer Terms and Privacy Policy.

Amounts are shown in US dollars unless stated otherwise. When raising an existing listing, you generally pay the difference between its prior paid total and the new total. Bids are final and non-refundable once successfully applied, except where a refund is required by law or approved through the merchant of record. Taxes or conversion costs may be added at checkout.

6. Prohibited conduct

You must not use BidInsta to impersonate another person, list a handle without authority, infringe intellectual property or privacy rights, promote illegal or harmful material, distribute malware, manipulate analytics, interfere with the service, evade payment, abuse chargebacks, scrape the service in a harmful manner, or violate applicable law.

We may reject, hide, suspend, correct, or remove a listing; freeze a ranking; block access; or cooperate with a payment provider or lawful authority when reasonably necessary to protect the service, users, third parties, or legal compliance.

7. Third-party services and links

BidInsta links to Instagram profiles and relies on third parties including Dodo Payments, Vercel, and Supabase. We do not control and are not responsible for third-party websites, platforms, outages, policies, content, security, or actions. Your use of those services is governed by their own terms.

8. Service availability and changes

The service is provided on an “as is” and “as available” basis. We may change, pause, discontinue, repair, or restrict any part of BidInsta, including rankings and features, without guaranteeing uninterrupted, secure, error-free, or permanent availability. We may correct obvious pricing, ranking, payment, or data errors.

9. Disclaimer of warranties

To the fullest extent permitted by law, BidInsta disclaims all express, implied, statutory, and other warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and any warranty arising from course of dealing or usage of trade. Mandatory consumer rights that cannot lawfully be waived remain unaffected.

10. Limitation of liability

To the fullest extent permitted by law, BidInsta and its operator will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; loss of profit, revenue, data, goodwill, followers, reach, opportunity, or business interruption; or damages arising from third-party platforms, unauthorized handles, account action, reliance on analytics, or inability to use the service.

To the fullest extent permitted by law, the total aggregate liability of BidInsta and its operator for all claims relating to the service will not exceed the amount you actually paid for the specific BidInsta transaction giving rise to the claim. Some jurisdictions do not allow certain exclusions or limits, so those provisions apply only to the maximum extent legally permitted.

11. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless BidInsta and its operator from claims, losses, liabilities, damages, costs, and reasonable legal fees arising from your submitted handle, your Instagram account or content, your breach of these Terms, your violation of law or third-party rights, or your misuse of the service.

12. Termination and surviving provisions

You may stop using BidInsta at any time. We may restrict or terminate access for breach, risk, fraud, abuse, legal requirements, or protection of the service. Sections concerning payments, licenses already granted, platform risk, disclaimers, liability, indemnity, and disputes survive termination where their nature requires it.

13. Changes and general terms

We may update these Terms by publishing a revised version and changing the effective date. Material changes may require renewed acceptance. If any provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. Failure to enforce a provision is not a waiver.

Nothing in these Terms excludes liability or rights that applicable law does not permit the parties to exclude.
